ORDINANCE #25-2008

AN ORDINANCE AMENDING CHAPTER 271-30, SECTION B OF THE CODE OF THE TOWN OF
HAMMONTON, COUNTY OF ATLANTIC ENTITLED “CROSSWALKS”

WHEREAS, the Municipal Engineer and the Police Chief of the Town of Hammonton having conducted a review of necessary amendments to Chapter 271-30, Section B, and that the Mayor and Town Council having considered it is in the best interest of the Town to amend this specific section; and
WHEREAS, The Town of Hammonton and the Downtown Merchants are cooperatively working together to complete various roadway and parking lot improvements along Vine Street extending between Central Avenue (CR #542) and Second Street; and
WHEREAS, the “Hammonton Revitalization Corporation – Friends of the Eagle Theatre” is seeking to renovate and restore the original Eagle Theater located within this block; and
WHEREAS, it is anticipated that with the completion of the improvements in this area of Vine Street there will be an increase in pedestrian traffic within the Downtown and Vine Street area of the Town; and
WHEREAS, in the interest of public safety and convenience there will be a need to provide for a mid-block pedestrian crossing within this area of Vine Street.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Town Council of the Town of Hammonton, County of Atlantic, that Chapter 271-30, Section B is hereby amended as follows:
SECTION B. Section 271-30, Schedule B entitled “Crosswalks” is hereby amended by the addition of the following:

NAME OF STREET CROSSING TYPE LOCATION
Vine Street Pedestrian From the centerline of Central Avenue (CR#542)
and extending to a point 10 feet southwesterly

RESOLUTION # 92-2008

RESOLUTION AWARDING A PROFESSIONAL SERVICES CONTRACT TO BENEDETTO ASSOCIATES
FOR HAMMONTON SENIOR CITIZEN/COMMUNITY CENTER

WHEREAS, the Town of Hammonton desires to retain the services of a consultant to provide Architectural Services for Hammonton Senior Citizen/Community Center; and
WHEREAS, Benedetto Associates, PO Box 562, Hammonton, New Jersey qualifies as a professional providing the services requested by the Town of Hammonton; and
WHEREAS, N.J.S.A. 40A:11-1 et seq. requires that a Resolution authorizing the awarding of a contract for professional services without competitive bidding and the intended contract be available for public inspection.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Common Council of the Town of Hammonton in the County of Atlantic and State of New Jersey that a Professional Services contract be entered into with
Benedetto Associates consistent with the form of contract which is annexed hereto and made a part hereof for a total compensation not to exceed $36,000.00 and broken down as follows:

Schematic Design Phase: $5,400.00 percent (15%)
Design Development Phase: $7,200.00 percent (20%)
Construction Documents Phase: $16,200.00 percent (45%)
Bidding or Negotiation Phase: $1,800.00 percent ( 5%)
Construction Phase: $5,400.00 percent (15%)
Total Basic Compensation: $36,000.00 percent (100%)

Rate Beyond Basic Services per Paragraph 3.2 of contract: $125.00 per hour

BE IT FURTHER RESOLVED that the contract is awarded (contingent upon proposed funding being finalized) without competitive bidding as a professional services contract in accordance with N.J.S.A. 40A:11-5(1)(a) of the Local Public Contract Laws, as Benedetto Associates do maintain the required knowledge and expertise as required under the Statutes of the State of New Jersey; and
BE IT FURTHER RESOLVED that the Mayor of the Town of Hammonton is authorized to execute a contract with Benedetto Associates when proposed funding is finally approved; and
BE IT FURTHER RESOLVED that a notice of this action taken by Mayor and Council shall be printed once in the designated newspaper for legal publications for the Town of Hammonton.

CAPITAL ORDINANCE APPROPRIATING $600,000 FOR HOUSING REHABILITATION AND SENIOR CENTER PROJECT BY THE TOWN OF HAMMONTON, IN THE COUNTY OF ATLANTIC, NEW JERSEY

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF HAMMONTON, IN THE COUNTY OF ATLANTIC, NEW JERSEY AS FOLLOWS:
Section 1. The Town Council hereby appropriates $600,000 for owner-occupied housing rehabilitation and the conversion of an existing facility into a senior citizens center, in accordance with the plans and specifications on file in the office of the Clerk, which plans are hereby approved including all work and materials necessary and incidental thereto, which amount consists of $200,000 for the owner-occupied housing rehabilitation and $400,000 for the conversion of the existing facility into a senior citizen’s center, both in the form of grants from New Jersey State Department of Community Affairs, Small Cities Community Development Block Grant (Grant Numbers 2008-02292-2121-00 and 2008-02292-2122-00, respectively). The appropriation includes all costs associated with the abovementioned projects.
Section 2. The capital budget of the Town of Hammonton is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection.
Section 3.This ordinance shall take effect as provided by the law.

AN ORDINANCE AMENDING ORDINANCE # 30-2007
ESTABLISHING A PURCHASE ORDER PROCEDURE

BE IT ORDAINED by the Mayor and Council of the Town of Hammonton, in the County of Atlantic and State of New Jersey, as follows:
SECTION I. PURPOSE
In order to provide for control and accountability over all expenditures by the Town of Hammonton, and in recognition of the essential need to maintain viable procedures so that the business operations of local government may proceed in an efficient and timely manner, this ordinance shall be adopted which shall set forth the procedures to be followed in order to make purchases by any Department Head (or in their absence, the next in charge in the Department) of the Town of Hammonton.
SECTION II. APPLICABILITY
The regulations and requirements outlined herein shall be applicable for all purchases by all Department Heads of the Town of Hammonton.
SECTION III. PROCEDURES
It is determined that each Town Department shall be allocated funds for the annual operation of said department. The Head of that Department is responsible for purchases on behalf of the department and shall:
1. First obtain a verbal or written quote/cost for the proposed or requested purchase.
2. Accurately complete and sign a requisition and submit same to the Finance Department of the Town of Hammonton.
3. Wait until the Finance Department has issued a purchase order (which authorizes the purchase to be made) describing the item to be purchased and cost of same, before actually making the purchase. Head of Department shall issue the purchase order to the vendor in person or by fax and this authorizes the vendor to remit the product or service and guarantees payment of same will be made by the Town of Hammonton so long as the product or service is remitted to the satisfaction of the Town of Hammonton.
4. If a product or service must be ordered, then it is the department heads responsibility to review the monthly list of bills to be paid and sign off on same that all bills listed are accurate and have been received to the satisfaction of the Town of Hammonton. Products or service on order and not received by the Town should not be paid for ahead of time. The purchase order is the legal document authorizing the order or purchase and guaranteeing payment of same.
5. Department Head is responsible for working within his/her annual budget. This means Department Head should anticipate all possible expenditures for budget year and pre encumber those funds so that he/she may work with the remaining department budget balance.
6. Department Head may not exceed his/her allocated budget in any given year.
7. Department Head must review his/her departments budget balances which appear on the monthly council meeting agenda’s e mailed to department head under the Town Clerk Report.
8. For purchases/requisitions exceeding $250.00 the Council Committee must also sign requisition before it is submitted to the Finance Office for review and approval and issuance of a purchase order.
9. For purchases for products or services exceeding $3,150.00 or the percentage of the Bid Threshhold as determined by the State of New Jersey for any particular year, department head must attempt to receive 2 or more quotes and attach same to his/her requisition prior to Council Committee Chair signature.
10. For purchases exceeding $17,500 or the amount set by State of New Jersey (Pay to Play Law) in any given budget year, Department Head must contact Finance Office and/or Town Clerk/Administrator Office to ascertain how the purchase may be made.
11. For purchases exceeding $21,000 or the amount set by State of New Jersey Bidding Laws in any given year, Department Head must contact Finance Office and/or Town Clerk/Administrator Office so that they may formally bid that product or service.
12. Multiple purchases of the same product or service in any given budget year must be calculated in total to determine how the purchase can legally be made.
13. Should an emergency arise, department head must contact Finance Office and/or Town Clerk/Administrator Office for direction prior to making any purchase for product or service.
14. Should the Department Head receive a letter during any given budget year from the Finance Office and/or Town Clerk/Administrator Office mandating “no further spending” in his/her department due to previous overexpenditures and/or lack of sufficient funding in that department, department head must comply. Should department head continue to make purchases at any point after receiving this letter, he/she may automatically be suspended.
15. Should a department head turn in an incomplete requisition to the Finance Office it will be returned with a letter stating reason for same and if the purchase pre dates the requisition and purchase order, it will be taken to Mayor and Council for review and department head will be subject to disciplinary action for the unauthorized purchase.
16. Purchase procedures shall include but not be limited to the following: purchases made from department budget allocation, bond ordinances, trust funds, grants or any other purchase made.
17. No final payment shall be made to a vendor until an invoice is attached to the purchase order being paid, as well as the packing slip. If no packaging slip is attached then the department head receiving the product or service must sign off on a receipt of services/product form.

SECTION IV. REPEALER
Any ordinance or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed as to such inconsistency only.
SECTION V. COMPLIANCE WITH STATE LAW.
Any purchase made by the Town of Hammonton is still governed by the State of New Jersey laws.
SECTION VI. EFFECTIVE DATE.
This ordinance shall take effect upon publication and passage according to law.

An Ordinance for Determining Positions Eligible for the Defined Contribution Retirement Program in the Town of Hammonton County of Atlantic, New Jersey

Whereas, the State Legislature recently adopted Chapter 92 of the Laws of 2007 (N.J.S. 43:15C-1 et seq.) to create the Defined Contribution Retirement Program to provide retirement benefits to various county and municipal officials; and,
Whereas, N.J.S. 43:15C-2 requires the governing body of each county, municipality, and other local entity to adopt, as appropriate, either a resolution or ordinance to determine the positions that are substantially similar in nature to the advice and consent of the Senate for appointments by the Governor of the State, pursuant to guidelines or policy that shall be established by the Local Finance Board in the Department of Community Affairs, and for which officials appointed to such positions shall be eligible for and shall participate in the Defined Contribution Retirement Program, subject to the provisions of law; and,
Whereas the Mayor and Council of the Town of Hammonton has considered the guidelines issues by the Local Finance Board;
Therefore, Be it ordained by the Mayor and Council of the Town of Hammonton that:
Pursuant to N.J.S. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
a. Business Administrator
b. Water Superintendent
c. Sewer Superintendent
d. Recreation Director
e. Municipal Court Administrator
f. Road Superintendent
g. Town Solicitor
h. Municipal Prosecutor

This ordinance shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
Should any part or parts of this ordinance be held to be invalid by any competent court of law, such invalidity shall only affect the part or parts held to be invalid, and all other parts shall remain in effect.
A copy of this ordinance shall be filed with the Director of the Division of Pensions & Benefits of the New Jersey Department of the Treasury.
This Ordinance shall take effect upon approval and publication according to law.

ORDINANCE DEDICATING $1.5 MILLION TOWARD A DEBT REDUCTION PLAN BY THE TOWN OF HAMMONTON,
IN THE COUNTY OF ATLANTIC, NEW JERSEY

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF HAMMONTON, IN THE COUNTY OF ATLANTIC, NEW JERSEY AS FOLLOWS:
Section 1. The Town of Hammonton and the South Jersey Gas Company, Folsom, New Jersey entered into a settlement agreement in 2007, whereby the Company agreed to pay the Town $2,500,000 for costs that it incurred for the re-location of new production wells at the request of the Company.
Section 2. The $2,500,000 has been paid to the Town by the Company and such amount is currently available in the Town’s Water Capital Fund balance.
Section 3. The Town Council now wants establish a “Debt Reduction Plan,” for the purpose of allocating the $1,500,000 toward the payment of debt service in the Current Fund for the following years and at the amounts indicated:

NOTICE TO ALL TOWN WATER USERS

Hammonton is a wonderful place to live. Beautiful homes along with lush well manicured landscaping. All that lush landscaping is causing an excessive amount of water use beyond the limits suggested and permitted by the NJDEP. No one wants to lose their plants, shrubs or lawn. But there is a way to have a beautifully landscaped yard without over watering. In order to adhere to State Water Conservation Standards, we request that each homeowner and business owner put into practice the following measures.
The sprinkler systems only need to run for 30 minutes in each zone every other day. So if your house number is “even” you can water on Monday, Wednesday and Friday. If you house number is “odd” you can water on Tuesday, Thursday and Saturday. Leave Sunday as a day of rest for the Town’s wells on the water system.
Our usage for water sprinklers has dramatically increased to a point where water conservation measures must be exercised by everyone. Homeowners and businesses with individual wells should also consider exercising these water conservation measures. One of the most dramatic abuses of the public water system is irrigation during rain events. The installation of rain sensing devices on your irrigation system will eliminate this abuse.
The Town Water Department cannot over emphasize the importance of conserving water. We hope everyone in the Town will read this notice and do what is right to help us stay out of harms way and get us through the summer without incident and risk of fines or the establishment of mandatory water restrictions.

The proposed public development is to authorize an increase in the town’s currently approved monthly and annual water diversion limits set by NJDEP’s Bureau of Water Allocation. Public notice is hereby given that sealed proposals will be received by the Hammonton Mayor and Council, Hammonton, New Jersey for the Demolition of the Existing Municipal Building, located at 100 Central Avenue, Hammonton, Atlantic County, New Jersey.
Proposals will be received until 10:00 am prevailing local time on Wednesday, April 23, 2008 when the same shall be opened and read aloud at The Hammonton Municipal Building, 100 Central Avenue, Hammonton, New Jersey 08037. Bids will not be accepted after the specified time.
In strict accordance with the plans and specifications, sealed proposals will be received in envelopes clearly marked “Municipal Building Demolition” which shall be mailed to the address noted above and contain the sender’s name and return address.

AN ORDINANCE ESTABLISHING CHAPTER 6-33A OF THE CODE OF THE TOWN OF
HAMMONTON ENTITLED “BOARDS, COMMITTEES AND COMMISSIONS”

WHEREAS, an amendment to the current Rent Control Board is required;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON, that Chapter 6-33A Rent Control Board be established as follows:
The Rent Control Board established by Ordinance 2-1976 on March 8, 1976 shall cease to exist at midnight on December 31, 2008 (the termination date). After the termination date, the functions previously performed by the Rent Control Board shall be performed by the Council committee known as the “Quality of Life Committee”. Between the date of approval of this amendment and the termination date, the Rent Control Board shall continue to function at those meetings where it has a quorum. In those circumstances where it is unable to muster a quorum, the Quality of Life Committee shall be authorized to act in its place and stead.

WHEREAS, Mayor and Council have concluded that the provisions of the current Rent Control ordinance of the Town of Hammonton need to be updated;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON, that Chapter 217-25 Partial Repeal be established as follows:
The provisions of this ordinance (Chapter 217:Rent Control) shall no longer apply to any lease or rental agreement entered into on or after the effective date of this amendment. Those leases and rental agreements shall hereinafter be known as Market Leases and/or Market Rental Agreements, as appropriate, and rents established thereunder shall no longer be limited by the provisions of Chapter 217. Any leases or rental agreements in existence prior to the effective date of this amendment shall continue to be subject in all respects to the provisions of Chapter 217. However, upon the termination of occupancy by a tenant whose rent was previously governed by Chapter 217, the rental cap formerly provided by Chapter 217 shall cease to exist.

AN ORDINANCE REPEALING ARTICLE I, CHAPTER 6
OF THE CODE OF THE TOWN OF HAMMONTON ENTITLED
“SHADE TREE COMMISSION”

WHEREAS, Mayor and Council have concluded that the purposes for which Article I, Chapter 6 were created no longer exist due to the services being provided by State and County agencies in the absence of a local Shade Tree Ordinance and Commission;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON, that Article I, Chapter 6 be repealed; and
BE IT FURTHER RESOLVED that all property from the curbline to the house/structure be the homeowner’s responsibility and such responsibility to include safety, upkeep/maintenance and tree removal; and
BE IT FURTHER RESOLVED that the property owner must still receive approval for all tree removal requests on his/her property from the Town of Hammonton Environmental Commission as per Article II, Chapter 267 “Tree Preservation and Maintenance,” and
BE IT FURTHER RESOLVED that if a portion, section, subsection, paragraph, or provision of this ordinance shall be declared invalid by a court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole or any other part thereof.

ORDINANCE # 10-2008

AN ORDINANCE AMENDING CHAPTER 48-15
OF THE CODE OF THE TOWN OF HAMMONTON ENTITLED
“Employees to be covered” by health benefits

WHEREAS, Mayor and Council have discussed and agreed upon an amendment to Chapter 48-15 that would exclude the Mayor and members of Council from receiving health benefits from the Town of Hammonton; and
WHEREAS, Mayor and Council have discussed and agreed upon an amendment to Chapter 48-15 that would exclude the Mayor and members of Council from receiving the health benefits buyout from the Town of Hammonton.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON, Chapter 48-15 of the Code of the Town of Hammonton be amended as follows:
The Town of Hammonton shall provide coverage to those employees that are considered full time only, excluding elected officials. All terms and conditions of coverage shall be specified in the appropriate employee contract. Employees that obtain full time status shall be provided coverage as soon as practicable, taking into consideration the requirements of the medical insurance provider. If an employee is already covered by virtue of an insurance plan offered by an employer other than the Town of Hammonton or by the employee’s spouse’s employer, or otherwise, the employee may elect to waive the Town’s insurance benefit plan and may elect compensation in lieu of benefits as permitted by the New Jersey Health Insurance Plan. Elected officials are also excluded from the election of compensation in lieu of benefits.
BE IT FURTHER RESOLVED that the disqualification of elected officials from electing compensation in lieu of benefits shall be effective January 1, 2008; and
BE IT FURTHER RESOLVED that the disqualification of elected officials from Town of Hammonton health insurance coverage shall be effective January 1, 2009; and
BE IT FURTHER RESOLVED that if a portion, section, subsection, paragraph, or provision of this ordinance shall be declared invalid by a court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole or any other part thereof.
