AN ORDINANCE AMENDING CHAPTER 204-18F
PEDDLERS, SOLICITORS AND TRANSIENTS MERCHANTS

BE IT RESOLVED by the Mayor and Council of the Town of Hammonton, County of Atlantic, State of New Jersey, that Chapter 204-18F be amended by adding the following to this paragraph:
The applicant shall also certify that: (1) no merchandise being sold violates or otherwise infringes on any trademark, copyright or official licensing rights of any other individual or entity and (2) that the peddler, hawker, vendor, solicitor and/or canvasser engaging in the sale of trademarked, copyrighted and/or licensed merchandise shall present at the time of application and maintain at the location of sale satisfactory written proof that it is an authorized seller of the merchandise and/or that it has purchased the merchandise from a licensed vendor.
BE IT FURTHER RESOLVED that all ordinances or parts of ordinances inconsistent herewith are
hereby repealed; and
BE IT FURTHER RESOLVED if any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof; and
BE IT FURTHER RESOLVED this ordinance shall take effect after second reading and publication as required by law.

NOTICE OF HEARING
TOWN OF HAMMONTON
PLANNING BOARD

In compliance with the pertinent provisions of the Town of Hammonton Zoning and Land Development Ordinance and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned Applicant with the Planning Board of Town of Hammonton for a Preliminary and Final Minor Subdivision Approval. The property is known and designated as Block 3801, Lot 33 & Lot 21.01 on the Tax map of the Town of Hammonton, County of Atlantic and State of New Jersey and is commonly known as 124-126 Batchelor Lane, located in a R-1 Zoning District. The requested action includes the subdivision of lot 33 into two (2) lots, shown on the maps as proposed lots 33.01 and lots 33.02: with one of the two lots (lot 33.01), already improved, not abutting an improved street and shall have access from a private drive. The other lot (33.02) will abut Batchelor Lane and is intended for residential use as permitted. Bulk variances and waivers shall be requested from the requirements of Chapter 175-113 et seq., which provides in part that building lots require abutment to an improved street unless adequate access for fire-fighting equipment, ambulances and other emergency vehicles and other requirements are satisfied pursuant to section Chapter 175-113(G). AN ORDINANCE AMENDING
5-2008
FIRE DEPARTMENT BILLING

BE IT ORDAINED by the Mayor and Council of the Town of Hammonton in the County of Atlantic, New Jersey, that the Code of the Town of Hammonton, County of Atlantic, New Jersey, is hereby amended as follows:
(NEW)-Section 8: Notwithstanding the foregoing, the Town and the Fire Department shall waive their subrogation rights, if any, to the extent it receives payment for any claim hereunder from the Joint Insurance Fund and specifically assigns to the Joint Insurance Fund and/or its agents, servants and employees, the right to pursue such subrogation claims on behalf of the Town and Fire Department.

BE IT ORDAINED by the Mayor and Council of the Town of Hammonton in the County of Atlantic, New Jersey, that the Code of the Town of Hammonton, County of Atlantic, New Jersey, is hereby as follows:
N.J.S.A. 48:3-17(a) permits municipalities to adopt an Ordinance requiring public utilities to take certain action, including, but not limited to, notifying the municipal construction code official prior to undertaking certain work involving public utilities within the confines of a municipality.
The Town of Hammonton wishes to adopt an Ordinance pursuant to the aforesaid statute so that:
The Town of Hammonton construction code official is notified prior to the commencement of any utility work occurring within the Town of Hammonton; and
That the Town of Hammonton possess the powers to require site restoration in the vicinity of the work in question; and
That the Town of Hammonton be authorized to assess a fine if that work has not been completed within the time limits set forth in the aforesaid statute.
The Town hereby designates the Hammonton Fire Department as the entity responsible for monitoring and maintaining a record of those locations within the municipality requiring pole removal, underground facility restoration, right-of-way repair and/or debris removal and hot patch restoration, all pursuant to subparagraph 1.c of N.J.S.A. 48:3-17(a).
Mayor and Council further direct that to the extent that a fine is received pursuant to subsection 1.e of the aforesaid statute, those funds shall be transmitted to the Hammonton Fire Department to defray the cost of administrative monitoring as described hereinabove.

This Ordinance shall take effect immediately upon due passage and publication according to law.

Defined Contribution Retirement Program

Whereas, the State Legislature has adopted Chapter 92 of the Laws of 2007 (N.J.S. 43:15C-1 et seq.) to create the Defined Contribution Retirement Program to provide retirement benefits to various county and municipal officials; and,
Whereas, N.J.S. 43:15C-2 requires the governing body of each county, municipality, and other local entity to adopt, as appropriate, either a resolution or ordinance to determine the positions that are substantially similar in nature to the advice and consent of the Senate for appointments by the Governor of the State, pursuant to guidelines or policy that shall be established by the Local Finance Board in the Department of Community Affairs, and for which officials appointed to such positions shall be eligible and shall participate in the Defined Contribution Retirement Program, subject to the provisions of law; and,
Whereas the Mayor and Council of the Town of Hammonton has considered the guidelines issues by the Local Finance Board;
Therefore, Be it ordained by the Mayor and Council of the Town of Hammonton that:
Pursuant to N.J.S. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:

1. BIDS: Sealed Bids for the Fourth Street Roadway Improvements, in the Town of Hammonton, will be received at 10:00 a.m. on Thursday, June 24, 2010 at which time Bids will be publicly opened and read aloud at the Council Chambers, located at 100 Central Avenue, Hammonton, NJ 08037. ORDINANCE # 009- 2010

AN ORDINANCE TO AMEND CHAPTER 175 OF THE
GENERAL ORDINANCE OF THE TOWN OF HAMMONTON

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON IN THE COUNTY OF ATLANTIC AND STATE OF NEW JERSEY AS FOLLOWS:

Section 1. Section 175-145 of the Town of Hammonton Land Development Ordinance is amended to read as follows:

L. Flag Lots.

(1) Definitions.
(a) Flag Lot - A lot not satisfying the conventional minimum lot frontage requirements of the zone district, generally configured in the shape of a flag, with its road frontage provided by a strip of land referred to as the “pole” or “flagstaff” portion of the lot.
(b) Flagstaff or Pole - The portion of a flag lot consisting of a strip of land with insufficient lot frontage which, when setback limitations are applied, contains no building envelope. The primary purpose of the flagstaff or pole is to provide road frontage and access for a flag lot
(c) Flag - The portion of the flag lot at the end of the pole.
(2) In a minor subdivision, one (1) lot may be permitted which fails to meet the minimum lot width requirements for a conventional residential development in the subject zone, provided that:
(a) That portion of the flag lot providing access to the rear of said lot must be no less than fifty (50) feet in width, no more than four hundred (400) feet in length extending uniformly from the lot frontage line to the rear lot line of the non-flag-type lot. This area shall be known as the “pole” of the flag. Notwithstanding the previous sentences, the total area of the pole shall not exceed twenty percent (20%) of the total lot area. If the access strip is more than four hundred (400) feet long or serves more than one (1) dwelling unit, access to the rear shall be only by a standard municipal street and a cul-de-sac dedicated as a public street. Any dedicated municipal street must meet Residential Site Improvement Standards (“RSIS”). No structures may be constructed in the pole area nor in the areas of the pole as extended to the rear of the lot, except for a mailbox and/or trash enclosure which shall not be located within the sight triangle. (The “pole” of the flag, must be part of the lot as set forth above and cannot be satisfied through the obtainment of an easement across any other lot). (b) Only one (1) lot of insufficient width is permitted, and such lot shall have at least three times the minimum lot area, but in no case shall a flag lot be less than: i) one point six (1.6) acres in size when such lot has public sewerage available; and ii) three point two (3.2) acres in size when such lot has no public sewerage available.
(c) The flag portion of the flag lot shall require one hundred (100) foot front and rear yard setbacks and eighty (80) foot side yard setbacks for any dwelling, building and/or structure.
(d) All lots other than the flag lot shall have a minimum lot width of one hundred (100) feet.
(e) An Applicant requesting a flag lot subdivision may not own any contiguous lot or lots which would, if combined, provide sufficient lot frontage and lot width to create conforming, non-flag-type lots.
(f) Placement of a private driveway within the pole shall provide for a minimum ten (10) foot open space grass or landscaped area between the adjacent property line and the edge of the private driveway. A private driveway within the pole shall be no less than twenty (20) feet wide and shall be no less than twenty-four (24) feet, measured along the curb line, from any adjacent driveway.
(g) The flag lot must contain a turn-around area so that an exiting vehicle can exit in a forward direction.
(h) All flag lots shall meet all applicable standards as established by the Town of Hammonton Fire Chief to ensure safe access to the property by emergency vehicles.

AN ORDINANCE TO AMEND ARTICLE IV, CHAPTER 247 OF THE GENERAL ORDINANCE OF THE TOWN OF HAMMONTON

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON IN THE COUNTY OF ATLANTIC AND STATE OF NEW JERSEY AS FOLLOWS:

Section 1. Article IV, Section 247-28 of the Town of Hammonton Land Development Ordinance is Deleted.
Section 2. Article IV, Section 247-29 of the Town of Hammonton Land Development Ordinance is Deleted.
Section 3. Article IV, Section 247-30 of the Town of Hammonton Land Development Ordinance is re-numbered Section 247-28.
Section 4. All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance are repealed to the extent of the inconsistency.
Section 5. If any section, sentence, or other part of this Ordinance is adjudged unconstitutional or invalid, that Judgment shall not effect, impair or invalidate the remainder of this Ordinance, but shall be limited in its effect to the specific section, sentence or other part of this Ordinance directly involved in the controversy in which the judgment shall have been rendered.
Section 6. This Ordinance shall take effect immediately upon final adoption and publication as required by law.

FOR lease of 52.5 acre tract adjacent to Hammonton Municipal Airport for farming purposes.
The town of Hammonton is seeking proposals from experienced farmers to lease the 52.5 acre tract of land adjacent to the Hammonton Airport known as Block 5702, Lot 14 on the Town of Hammonton tax map. The use pursuant to that lease shall be limited to the growing of farm product, specifically sweet potatoes.

ORDINANCE AMENDING THE CODE OF THE
TOWN OF HAMMONTON
CHAPTER 241,
SOLID WASTE, SECTION 241-19, AND SECTION 241-20

BE IT ORDAINED by the Mayor and Council of the Town of Hammonton in the County of Atlantic, New Jersey, that the Code of the Town of Hammonton, County of Atlantic, New Jersey, Chapter 241 is hereby amended as follows:
Section 241-19(B) is hereby deleted and the following language is hereby inserted in its place and stead:
241-19 (B) The Town of Hammonton shall not be responsible for the disposal of trade waste, construction debris, hazardous waste, or waste related to the transfer of ownership of a residential property or the change of occupancy by a residential tenant thereof. It shall be the responsibility of the property owner and/or tenant to arrange, in those circumstances, for a solid waste collection contractor to remove the aforedescribed waste. The fine for failure to comply with the provisions of this subsection shall be the sum of seventy-five dollars ($75.00), and shall be payable through the violations bureau of the Hammonton Municipal Court without the necessity of a Court appearance.
BE IT FURTHER ORDAINED by the Mayor and Council of the Town of Hammonton in the County of Atlantic, New Jersey, that the Code of the Town of Hammonton, County of Atlantic, New Jersey, Chapter 241-20A (8) is hereby deleted and the following language is hereby inserted in its place and stead:
241-20A (8) Brush shall only be placed for collection in a single pile not exceeding four (4) feet in height, six (6) feet in length, and six (6) feet in width. The fine for failure to comply with the provisions of this subsection shall be the sum of seventy-five dollars ($75.00), and shall be payable through the violations bureau of the Hammonton Municipal Court without the necessity of a Court appearance.
BE IT FURTHER ORDAINED by the Mayor and Council of the Town of Hammonton in the County of Atlantic, New Jersey, that the Code of the Town of Hammonton, County of Atlantic, New Jersey, Chapter 241-20A (11) is hereby deleted and the following language is hereby inserted in its place and stead:
241-20A (11) Bulk items,(as defined in this Chapter), shall not be collected with the regular weekly collection but may be collected in accordance with a schedule as determined by the Overseer of Highways for the Town of Hammonton. The Town reserves the right to refuse collection of bulk materials which, in its opinion, are excessively heavy or cumbersome including, but not limited to, motor engine blocks, automobile bodies or portions thereof, truck bodies or parts, carpets and other similar materials. No refrigerators shall be placed for collection unless and until the door of the refrigerator and/or freezer has been completely removed from the hinges and the lock has been rendered inoperable. In no event shall any person or entity cause to be placed for collection any item in violation of this subsection, nor shall any person or entity cause to be placed for collection in excess of three (3) bulky items for any single collection. The fine for failure to comply with the provisions of this subsection shall be the sum of seventy-five dollars ($75.00), and shall be payable through the violations bureau of the Hammonton Municipal Court without the necessity of a Court appearance.

Any Ordinance or parts of Ordinances inconsistent with the provisions of this Ordinance are hereby repealed as to such inconsistencies only.

This Ordinance shall take effect immediately upon due passage and publication according to law.

Pinelands Commission Public Development Approval

Please take notice that the South Jersey Transportation Authority (SJTA) has applied to the New Jersey Pinelands Commission for a Public Development Approval (PDA) and Freshwater Wetland General Permit #2 (FWGP2) for the installation of Intelligent Transportation Systems (ITS) along the Atlantic City Expressway (ACE) at Mileposts 7.2 and between Mileposts 17.7 to 36.3 in the Townships of Hamilton, Egg Harbor and the Town of Hammonton, Atlantic County; and Winslow Township, Camden County, New Jersey. The ITS systems for this project focus on SJTA's commitment of providing increased mobility, improving traffic flow, reducing congestion, increasing roadway information dissemination, and improving traffic monitoring along the ACE. The ITS consist of Closed Circuit Television (CCTV) camera surveillance, Dynamic Message Signs (DMS), Reader Assembly (tag readers), Roadway Weather Detection System, Travel Time System, and their associated conduits and junction boxes connecting them to an existing utility. This project compliments the previously approved ITS project between Mileposts 7.8 and 17.7. The Commission may take action on the application after 10 days from the date this notice is published and mailed. Written comments on the application may be submitted to the Pinelands Commission and that all such comments received within 10 days of the mailing or publication of this notice will be considered in the review of the application. The application is on file and available for inspection by appointment at the Pinelands Commission's office. ORDINANCE # 3-2010

AN ORDINANCE ENTITLED "AN ORDINANCE TO AMEND ARTICLE XII AND XIII OF CHAPTER 175 OF THE GENERAL ORDINANCE OF THE TOWN OF HAMMONTON", was introduced at the regular meeting of the Mayor and Council of the Town of Hammonton held January 25, 2010.

PURPOSE
The Town of Hammonton desires that all its employees recognize that polices and procedures are adopted to insure an efficient, fair, safe, and enjoyable work environment. Written rules are important to create that environment. It is the policies, procedures, rules and regulations outlined in the Employee handbook as the official guideline which employees must adhere to. This Handbook is not intended to be construed actually or by implication as an employee contract and does not superseded NJ CSC rules and regulations or any other State Authority. Though we cannot include everything in the employee handbook, we often make reference to Town of Hammonton Ordinances and Resolutions.

MODIFICATION
As laws and society change, there will always be the need for modification to the policies and procedures of the town. Any modification to the handbook, once adopted, shall be done with the same formality as its original creation. In an effort to advise town employees the employee handbook is located in its entirety on GeneralCode.com website under New Jersey and then Hammonton.

A RESOLUTION TO AFFIRM THE TOWN OF HAMMONTON’S
CIVIL RIGHTS POLICY WITH RESPECT TO ALL OFFICIALS, APPOINTEES, EMPLOYEES, PROSPECTIVE EMPLOYEES, VOLUNTEERS, INDEPENDENT
CONTRACTORS, AND MEMBERS OF THE PUBLIC THAT COME INTO
CONTACT WITH MUNICIPAL EMPLOYEES, OFFICIALS AND VOLUNTEERS

WHEREAS, it is the policy of Town of Hammonton to treat the public, employees, prospective employees, appointees, volunteers and contractors in a manner consistent with all applicable civil rights laws and regulations including, but not limited to the Federal Civil Rights Act of 1964 as subsequently amended, the New Jersey Law against Discrimination, the Americans with Disabilities Act and the Conscientious Employee Protection Act, and

WHEREAS, the governing body of Town of Hammonton has determined that certain procedures need to be established to accomplish this policy

NOW, THEREFORE BE IT ADOPTED by the Town of Hammonton that:

Section 1: No official, employee, appointee or volunteer of the Town of Hammonton by whatever title known, or any entity that is in any way a part of the Town of Hammonton shall engage, either directly or indirectly in any act including the failure to act that constitutes discrimination, harassment or a violation of any person’s
constitutional rights while such official, employee, appointee volunteer, or entity is engaged in or acting on behalf of the Town of Hammonton’s business or using the facilities or property of the Town of Hammonton.

Section 2: The prohibitions and requirements of this resolution shall extend to any person or entity, including but not limited to any volunteer organization or inter-local organization, whether structured as a governmental entity or a private entity, that receives authorization or support in any way from the Town of Hammonton to provide services that otherwise could be performed by the Town of Hammonton.

Section 3: Discrimination, harassment and civil rights shall be defined for purposes of this resolution using the latest definitions contained in the applicable Federal and State laws concerning discrimination, harassment and civil rights.

Section 4: The Town Clerk/Administrator shall establish written procedures for any person to report alleged discrimination, harassment and violations of civil rights prohibited by this resolution. Such procedures shall include alternate ways to report a complaint so that the person making the complaint need not communicate with the alleged violator in the event the alleged violator would be the normal contact for such complaints.

Section 5: No person shall retaliate against any person who reports any alleged discrimination, harassment or violation of civil rights, provided however, that any person who reports alleged violations in bad faith shall be subject to appropriate discipline.

Section 6: The Town Clerk/Administrator shall establish written procedures that require all officials, employees, appointees and volunteers of the Town of Hammonton as well as all other entities subject to this resolution to periodically complete training concerning their duties, responsibilities and rights pursuant to this resolution.

Section 7: The Town Clerk/Administrator shall establish a system to monitor compliance and shall report at least annually to the governing body the results of the monitoring.

Section 8: At least annually, the Town Clerk/Administrator shall cause a summary of this resolution and the procedures established pursuant to this resolution to be communicated within the Town of Hammonton. This communication shall include a statement from the governing body expressing its unequivocal commitment to
enforce this resolution. This summary shall also be posted on the Town of Hammonton’s web site.

Section 9: This resolution shall take effect immediately.

Section 10: A copy of this resolution shall be published in the official newspaper of the Town of Hammonton in order for the public to be made aware of this policy and the Town of Hammonton’s commitment to the implementation and enforcement of this policy.

Be it ordained by the Mayor and Town Council of the Town of Hammonton,
County of Atlantic and State of New Jersey as follows:

SECTION 1: PURPOSE
The Mayor and Council of the Town of Hammonton wish to amend Chapter 216-10 Rental Property Periodic Inspections to authorize the local inspection official to accept State inspection approvals in lieu of performing local inspections in certain cases as follows:

216-10 E. The owner of any property which is subject to an inspection every five (5) years by the State of New Jersey, Department of Community Affairs, Division of Codes and Standards, Bureau of Housing Inspections shall be permitted to provide the local inspection officer with a copy of a satisfactory report from that agency in lieu of being required to participate in the local inspection program in the year in which the state inspection occurred. For each year thereafter, the property shall be subject to local inspection hereunder (with the exception of any future year wherein a state inspection occurs consistent with the provisions of this section.

SECTION 2 - SEVERABILITY
If any part of this ordinance shall, for any reason adjudged by a court of competent jurisdiction be declared invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance which will be declared severable.

SECTION 3 - REPEALER
All previous Ordinances or parts thereof conflicting or inconsistent with the provisions of this Ordinance of the Code of the Town of Hammonton as adopted are hereby repealed.

Amending Chapter 74 of the Code of the Town of Hammonton

§74-1 Purpose.
An ever increasing number of homeowners and business owners are installing alarm systems in an effort to prevent crime. The installation of these systems should certainly be encouraged, because they tend to make the community safe. A result, however, of having so many properties with alarm systems is that the local Police Department is called upon to respond to false alarms. It is the purpose of this article to curtail the number or false alarms received by the Police Department.
§74-2 Designation of false alarm.
If the Police Department receives a call which requires an officer to be dispatched to a residence or dispatched to a business or dispatched to any location in the Town of Hammonton and, upon arrival, it can be determined that no property or person was in threat or harm or injury and the call or alarm to the Police Department was made by mistake, neglect or with the purpose to annoy and there is no justifiable reason to initiate the dispatch, the alarm shall be considered false.
§74-3 Constitution of violation.
An individual shall he considered to have violated this article if he or she initiated the false alarm or negligently allowed the false alarm to be made. It shall be presumed that the owner of any property that has an alarm system is the person who initiates or allows the alarm to be made. The presumption may be rebutted.
§74-4 Violations and penalties.

Anyone who is convicted of violating this article in the Hammonton Municipal Court is subject to the following penalties:
A.First offense: a warning with no fine or Court appearance required.

B. Second and subsequent offenses: a fine of $50 and no Court appearance required.

§74-5 Terms defined.

A “second or subsequent offense” shall be defined as any false alarm which occurs within a twelve-month period from January 1 through December 31 annually.

AN ORDINANCE APPROVING ANNUAL UPDATES TO EMPLOYEE HANDBOOK

I. PURPOSE
The Town of Hammonton desires that all it’s employees recognize that polices and procedures are adopted to insure an efficient, fair, safe, and enjoyable work environment. Written rules of dress, conduct, conditions of employment, etc. are important to create that environment. It is the policies, procedures, rules and regulations outlined in the Employee handbook as the official guideline which employees must adhere to. This Handbook is not intended to be construed actually or by implication as an employee contract and does not superseded NJ CSC rules and regulations or any other State Authority. Though we cannot include everything in the employee handbook, we often make reference to Town of Hammonton Ordinances and Resolutions.

II. ADOPTION AND NAME
The employee handbook which has been created through the efforts of the Town Solicitor, the Town Risk Manager, the Town Clerk/ Administrator, and the Deputy Town Clerk is hereby adopted and shall be originally known as the “Employee Handbook of the Town of Hammonton.”

III. MODIFICATION
As laws and society change, there will always be the need for modification to the policies and procedures of the town. Any modification to the handbook, once adopted, shall be done with the same formality as it’s original creation. LEASING OF
PROPERTY OWNED BY THE TOWN OF HAMMONTON
("A PORTION OF THE SOUTH HANGAR")
BLOCK 5702, LOT 14

The following paragraphs constitute the bid specifications related to the leasing of a portion of the property owned by the Town of Hammonton located at 75 Academy Drive, known as Block 5702, Lot 14 ("a Portion of the East Hangar").
Those specifications are as follows:
1. The Town intends to lease the premises in question for purposes of establishing a restaurant thereon.
2. The successful bidder must execute a standard three (3) year lease with two (2)-one year options within 15 days of the bid award.
3. The successful bidder shall demonstrate a minimum of five (5) years of experience in the restaurant business at the management or ownership level.
4. The minimum bid for the lease shall be as follows:
Year 1: $0.00 per month
(see paragraph 8 below)
Year 2: $600.00 per month
Year 3: $630.00 per month
5. Tenant shall be responsible for payment of its own utilities and for providing the Town with a Certificate of Insurance.
6. The minimum period of operation shall be as follows:
6 days per week (including both weekend days)
52 weeks per year.
7. The minimum hours of operation shall be from 6:00 a.m. to 2:00 p.m. and breakfast and lunch shall be served.
8. Any improvements to be made to the property to accommodate the successful bidder's work activity shall be compliant with all codes of the Town of Hammonton and shall be submitted in writing to and approved by Mayor and Council prior to commencement of work. The successful bidder shall be required to install a standard restaurant kitchen upon the premises. In consideration of there being no rental charge in year one of the lease, the equipment installed by the successful bidder shall remain on the premises upon lease termination. The successful bidder shall obtain all necessary municipal permits.
9. The rent shall increase at a rate of 5.0% per year over the course of the lease.
10. The Town reserves the right to reject any and all bids including the highest bid.
11. Security in the amount of 1 ½ times the monthly rent shall be held by the Town.
12. Bid forms shall be available in the Town Clerk's Office at 100 Central Avenue, Hammonton, New Jersey.
13. An optional pre-bid site inspection for any and all interested bidders shall occur on Tuesday, September 15, 2009 at 3:00 p.m. If a pre-bid inspection is requested, the interested party shall contact the municipal attorney, Brian G. ORDINANCE AMENDING
THE CODE OF THE
TOWN OF HAMMONTON
CHAPTER 261-4(d),
ENTITLED “TOWING”

BE IT RESOLVED by the Mayor and Council of the Town of Hammonton in the County of Atlantic, New Jersey, that the Code of the Town of Hammonton, Chapter 261-4(D) be amended as follows:

D. Towing contractors shall be required to purchase, maintain and provide during the time of service on the rotary list proof of insurance furnished by a reputable insurance company licensed to do business in the State of New Jersey, containing the following coverages with liability limits as set forth below:
1. Garage liability/comprehensive general liability insurance policy in an amount not less than $1,000,000 combined single limit coverage bodily injury and property damage liability, including but not limited to personal injury, products liability (where applicable), independent contractor and completed operation coverage.
2. Garagekeepers legal liability “direct primary” insurance policy in an amount not less than $100,000. Said policy must include both comprehensive and collision and an endorsement to include on hook.
3. Automobile liability insurance policy in an amount not less than $1,000,000 combined single limit covering bodily injury and property damage liability including but not limited to owned, nonowned and hired vehicles.
4. Worker’s compensation insurance as required by law, including, but not limited to, statutory New Jersey Worker’s Compensation benefits, and employers liability of at least $100,000.
5. Excess/umbrella liability. In the event that a garage liability and/or automobile liability cannot be purchased up to the required limit of $1,000,000 an excess liability or umbrella liability policy must be purchased to effect a total liability limit of $1,000,000. Excess or umbrella liability policies will not be required for garage or automobile policies that met or exceed the minimum limit of $1,000,000.
6. The garage liability policy shall name the Town of Hammonton as additional insured and certificate holder.
7. The contractor will execute an agreement to hold harmless, indemnify and defend, at the contractor’s expense, the Town, its employees and officials from any and all claims, demands, suit or action for personal injury or property damage brought against the Town, its employees and officials for any activities which arise out of any services performed under this chapter.
BE IT FURTHER RESOLVED that any Ordinance or parts of Ordinances inconsistent with the provisions of this Ordinance are hereby repealed as to such inconsistencies only.

AN ORDINANCE TO AMEND CHAPTER XIII OF CHAPTER 175 OF THE GENERAL ORDINANCE OF THE TOWN OF HAMMONTON

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HAMMONTON IN THE COUNTY OF ATLANTIC AND STATE OF NEW JERSEY AS FOLLOWS:
Findings. The Mayor and Council for the Town of Hammonton hereby make the following findings:
Parks, conservation areas, public playgrounds, public buildings, farms and churches, which are permitted as non-residential uses in the Residential-1 (R-1) Zoning District, are consistent with the currently permitted uses in the Mixed Use (MD) Zoning District.
Parks, conservation areas and public playgrounds would create green space in an otherwise generally urban district, which is consistent with the purposes of the Municipal Land Use Law which encourages municipalities to both provide for open space and to promote conservation and open space, all as set forth in N.J.S.A. 40:55D-2.
The actual development of properties in the MD Zoning District has occurred in a way that is consistent with permitting parks, conservation areas, public playgrounds, public buildings, farms and churches; and this development creates strong probabilities that potential development would require and be entitled to variance relief from the restrictions of the MD District.
The Planning Board of the Town of Hammonton has recommended that parks, conservation areas, public playgrounds, public buildings, farms and churches be permitted within the MD District; and that it is appropriate to change the permitted uses within the MD District, rather than have the potential for continuous changes made by zoning variance.
Section 175-158 of the Ordinance is amended to read as follows: 175-158.A.(1) Single Family Detached/Two Family Dwellings and Non-Residential Uses as permitted in the R-1 Zoning District.
All ordinances or parts of ordinances inconsistent with the provisions of this Ordinance are repealed to the extent of the inconsistency.
If any section, sentence, or other part of this Ordinance is adjudged unconstitutional or invalid, that Judgment shall not effect, impair or invalidate the remainder of this Ordinance, but shall be limited in its effect to the specific section, sentence or other part of this Ordinance directly involved in the controversy in which the judgment shall have been rendered.
This Ordinance shall take effect immediately upon final adoption and publication as required by law.

NOTICE TO BIDDERS
1. BIDS: Sealed Bids for the 3rd Street and Walmer Street ADA Improvements, in the Town of Hammonton, will be received at 10:00 a.m. on July 1, 2009, at which time Bids will be publicly opened and read aloud at the Town Hall, located at 100 Central Avenue, Hammonton, NJ 08037. Bids will not be accepted after the specified time.
The project will consist of the removal of designated existing curbs, sidewalks, trees and replacement of same to provide handicapped accessibility in accordance with the present ADA regulations. The work shall also include reconstruction of existing inlets, pipe replacement as needed, intersection reconstruction and the replanting of selected trees or as directed by the Engineer. The extent of actual project construction will be dependent upon the bids received and funding available.
Accordingly, the Town of Hammonton will award the project to the qualified Bidder who submits the lowest aggregate bid price for the project. However, the Town reserves the right to accept or reject any and all bids or to accept in whole or in part any bid which will best suit its needs and falls within the project budget consideration.
Bids must be on the official Bid Form which can be obtained from the Engineer, at the offices of Adams, Rehmann & Heggan Associates, Inc., 150 N. Second Street, Hammonton, NJ 08037 and accompanied by a Consent of Surety, a Non-Collusion Affidavit, other documents required pursuant to the specifications, and a certified check, cashier’s check or bid bond in the amount of 10% of the amount bid but not in excess of $20,000.00, and be delivered at the place on or before the hour named above. Each Bid must state the name and address of person, firm and corporation interested in the same as a principal. 3. WITHDRAWAL OF BIDS: Any Bid may be withdrawn prior to the above scheduled time for the opening of Bids or any authorized postponement thereof. Bids received after time and date designated shall not be considered. No Bidder may withdrawal a Bid for a period of sixty (60) calendar days after the actual date of the opening thereof.
4. AFFIRMATIVE ACTION REGULATIONS: Bidders are required to comply with the requirements of P.L. 1975, c.127 (NJAC 17:27).
Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project; that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, age, color, religion, sex, ancestry, national origin, or handicap; that a mandatory ratio of apprentices and trainees to journeymen is required in each craft and the Contractor (and any subcontractors) is obligated to make a “diligent effort” to achieve these ratios; and (that to the greatest extent feasible, opportunities for training and employment being given lower income residents of the project area and must to the greatest extent feasible utilize project area businesses located in or owned in substantial part by project area residents).
5. CONTRACT COMPLETION: Construction shall commence at the project site within fourteen (14) calendar days after the date to be specified in the written ‘Notice to Proceed’ by the Engineer and shall be completed within thirty (30) calendar days from the date the written ‘Notice to Proceed’ is given, unless otherwise agreed to.
6. PREVAILING WAGE REQUIREMENTS: The provisions of the Department of Labor’s current wage rate determinations and the New Jersey Prevailing Wage Act are requirements of this project.
7. PROJECT FUNDING: the 3rd Street and Walmer Street ADA Improvements is funded through the Atlantic County Improvement Authority’s Community Development Block Grant Program and therefore the successful bidder must comply and adhere to all policies and procedures of this office. The successful bidder shall also be responsible for complying with the applicable programs the most current NJDOT Standard Specification for Road and Bridge Construction.
8. MINORITY BUSINESS SET-ASIDE In addition of the Equal Employment requirements of Executive Order 11246, the contractor must also establish a 15% goal for female participation and a 15% goal for minority participation in his aggregate on-site construction work force, for contracts in excess of $10,000.00 whether or not part of that work force is performing work on a federal or federally assisted construction contract or subcontract. Documentary evidence of minority and women business enterprises who have been contacted and to whom commitments have been made shall be submitted prior to entering into a contract with the Town for the proposed project work.
9. PUBLIC WORKS CONTRACTOR REGISTRATION ACT: The provisions of the New Jersey Public Works Contractor Registration Act are requirements of this project.

Atlantic City Expressway
Public Development Approval

Take notice that the South Jersey Transportation Authority (SJTA) has applied to the New Jersey Pinelands Commission for a New Jersey Pinelands Commission Public Development Approval (PDA) for the widening of the Atlantic City Expressway westbound lanes to the median between Mileposts 8.0 and 31.0 in the Townships of Hamilton, Hammonton and Egg Harbor, Atlantic County and Winslow Township, Camden County, New Jersey. The Commission may take action on the application after 10 days from the date this notice is published and mailed. Written comments on the application may be submitted to the Pinelands Commission and that all such comments received within 10 days of the mailing or publication of this notice will be considered in the review of the application. The application is on file and available for inspection by appointment at the Pinelands Commission's office. Interested persons may comment to the Pinelands Commission with 10 days of the date of this notice. Comments should be sent to:
